Federal Bill Reintroduced: Temporary Nurse Aides Waiver
The Building America’s Health Care Workforce Act would extend certain flexibilities relating to training and competency requirements for nurse aides in Medicare skilled nursing facilities and Medicaid nursing facilities. Reps. Brett Guthrie (R-KY) and Madeleine Dean (D-PA) have reintroduced the bill to waive a requirement for temporary nurse aides to complete 75 hours of state-approved training and a competency evaluation in four months for two years beyond the public health emergency, which is currently slated to end in May. With workforce shortages in long-term care, advocates believe this new legislation would ensure seniors’ access to safe and quality care.
On January 30, the Biden Administration announced its intent to end the national emergency and public health emergency declarations on May 11, related to the COVID-19 pandemic. Many PREP Act authorities will end then if not not made permanent through federal and state legislation.
CMS finalized technical details regarding the Medicare Advantage Risk Adjustment Data Validation (RADV) program, which seeks to improve integrity and payment accuracy for Medicare Advantage (MA) plans. The rule also finalizes a policy to remove the Fee-for-Service previously applied in RADV audits.
The Centers for Disease Control and Prevention (CDC) released an update to the International Classification of Disease (ICD-10) codes for the current fiscal year. The codes should be used from April 1, 2023, through September 30, 2023. The list includes 42 new codes, seven deletions, and one revision. To search for codes, use the browser tool here.
